Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, mobile applications, chat services, and related services provided by What a Crock Meals to Go LLC (“Company,” “we,” “our,” or “us”). By using our Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and Age

You represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given us consent to allow your minor dependents to use the Services.

2. User Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use. We are not liable for any loss or damage arising from your failure to safeguard credentials. You are responsible for all activity conducted through your account.

2A. Electronic Communications and Notices

You consent to receive notices and communications electronically via the email associated with your account or via in-product messaging. By using the Services, you also consent to receive electronic communications, which may include emails, in-app messages, or SMS if you opt in. Such communications satisfy legal requirements for written notice.

2B. Mobile Terms of Service

The What a Crock Meals mobile message service (the "Service") is operated by What a Crock Meals (“What a Crock Meals”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to What a Crock Meals’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of What a Crock Meals through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, abandoned checkout, abandoned cart, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with What a Crock Meals. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18446513553 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other What a Crock Meals mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

3. Use Restrictions

You may use the Services only for personal, non-commercial purposes. Unauthorized resale, redistribution, or commercial use is prohibited unless expressly authorized in writing. You may not use the Services for unlawful purposes or transmit viruses, malware, or harmful code.

4. Intellectual Property & User Submissions

All content, trademarks, and intellectual property on the Services are owned by the Company or our licensors. You are granted a limited, non-transferable license to use the Services for personal, non-commercial use. If you submit content (reviews, comments, photos, feedback, or other materials), you grant us a worldwide, perpetual, royalty-free license to use, reproduce, modify, publish, and display that content in any media for business, marketing, or operational purposes. By submitting content, you represent and warrant that you own or have the necessary rights to the content, that the content is accurate, and that it does not violate these Terms or infringe the rights of any third party. You indemnify us against claims arising from your submissions. We are not responsible for user-generated content.

4A. DMCA Notice

If you believe content infringes your copyright, send a notice to help@whatacrockmeals.com including: (a) your signature; (b) identification of the copyrighted work; (c) the infringing material and its location; (d) your contact information; (e) a good-faith statement of lack of authorization; and (f) a statement under penalty of perjury that the notice is accurate and you are authorized to act. We may remove or disable access to allegedly infringing material within a reasonable time after receiving a compliant notice.

5. Products, Orders, and Returns

Product descriptions, pricing, and availability may change at any time without notice. We may refuse or cancel any order at our sole discretion. Quantities may be limited. Returns are governed by our separate Return Policy available on our website.

6. Important Allergen Disclaimer

Our products are prepared in a facility that handles milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, and soybeans. While we take precautions, we cannot guarantee products are free from allergens, and cross-contamination may occur. You are responsible for reviewing product labels and ingredients. We are not liable for illness or reactions from allergen exposure.

7. Food Safety, Title, and Risk of Loss

Title to all products and risk of loss passes to you upon our delivery to the carrier (e.g., FedEx, UPS). You are responsible for proper inspection, handling, storage, and preparation of all products. Products must remain frozen until ready to cook. We are not liable for spoilage, damage, or illness resulting from improper handling or storage after delivery.

7A. Shipping Estimates

Delivery windows are estimates only. We are not liable for carrier delays.

8. Pricing and Payment

All prices are subject to change without notice. Payment must be made at the time of order. We may refuse or cancel orders if fraud, unauthorized, or illegal activity is suspected.

9. Subscription and Auto-Renewal Plans

If you enroll in a subscription, your plan will automatically renew at the frequency you select. You will be charged the then-current subscription price, plus applicable taxes, at the start of each renewal term. Cancellation Policy: You may cancel your subscription at any time before 5:00 PM Eastern Time on the day before your next order is scheduled to ship. Cancellation is effective for the following shipment. You may cancel by logging into your account dashboard at whatacrockmeals.com/account or emailing help@whatacrockmeals.com.

10. Force Majeure

We are not liable for delay or failure due to causes beyond our control, including natural disasters, labor disputes, strikes, supply chain interruptions, carrier delays, pandemics, government restrictions, or power outages.

11. Third-Party Tools and Links

We may provide access to third-party tools or links. These are provided “as is” without warranties. We are not liable for third-party content, products, or services. Use of third-party sites is at your own risk.

12. Prohibited Uses

You may not:

  • Use the Services for illegal or fraudulent purposes;

  • Harass, abuse, or harm others;

  • Attempt to gain unauthorized access;

  • Upload malicious code;

  • Interfere with security features. Violation may result in suspension or termination.

13. Chat and AI Features

Our Services may include chat or AI-assisted features. You agree not to input sensitive personal, financial, medical, or government information. Chat may be processed by staff or AI tools. We do not guarantee accuracy of AI responses and disclaim liability for reliance on such content.

14. Disclaimer of Warranties

The Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of Liability

To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or related to the Services or products shall not exceed the total amount you paid to us for the specific product or service giving rise to the claim. We are not liable for indirect, incidental, punitive, or consequential damages. This limitation does not apply to damages caused by our gross negligence, willful misconduct, or for personal injury.

16. Indemnification

You agree to indemnify and hold harmless What a Crock Meals to Go LLC, its officers, employees, affiliates, and agents from claims, damages, liabilities, and expenses arising from your use of the Services, violation of these Terms, or infringement of others’ rights.

17. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or any other reason. Survival: Sections 4, 6–7A, 10, 13–16, 18–24 shall survive termination.

18. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Pennsylvania.

  • Binding Arbitration: Any dispute shall be resolved exclusively by binding arbitration in Delaware County, Pennsylvania, administered by the American Arbitration Association under its Consumer Arbitration Rules. Judgment may be entered in any court of competent jurisdiction.

  • Small-Claims Carve-Out: Either party may bring an individual action in a Pennsylvania small-claims court.

  • Injunctive Relief Carve-Out: Either party may seek court relief to protect intellectual property, prevent unauthorized access, or address data-security incidents.

  • Class-Action/Jury Waiver: You waive any right to participate in a class, consolidated, or representative action, or to a jury trial.

  • 30-Day Opt-Out: You may opt out of arbitration by emailing help@whatacrockmeals.com within 30 days of first use of the Services, stating your full name and intent to opt out.

  • One-Year Limitation: Any claim must be filed within one year of accrual, or it is permanently barred.

19. Assignment

You may not assign these Terms without our written consent. We may assign at any time.

20. Severability; Waiver

If any provision is unenforceable, the remainder remains in effect. Our failure to enforce any provision is not a waiver.

21. Entire Agreement

These Terms, together with our Privacy Policy and posted policies, form the entire agreement between you and the Company.

22. Export and Sanctions Compliance

You represent that you are not located in, under the control of, or a resident of any country or jurisdiction subject to U.S. trade sanctions or embargoes. You agree to comply with all U.S. export control laws and regulations.

23. Promotions and Coupons

Promotions, discounts, and coupons are subject to posted terms, have no cash value, are non-transferable, and may be changed or terminated without notice.
